These Terms and Conditions govern the use of ObsidianFalcon's services, including fractional ownership programmes, Jet Card memberships, and Falcon Club membership. Please read these terms carefully before entering into any agreement with ObsidianFalcon.
All programmes — Fractional Ownership, Jet Card, and Falcon Club — are subject to a signed programme agreement. These Terms and Conditions form part of that agreement and are incorporated by reference.
In the event of any conflict between a specific programme agreement and these Terms and Conditions, the specific programme agreement shall prevail. No binding commitment is created by any marketing material, website content, or verbal communication. A binding agreement arises only upon execution of a formal programme agreement and receipt of the applicable deposit or full payment.
ObsidianFalcon operates, or intends to operate, aircraft within the ultra-long-range large-cabin category. While our marketing materials reference the Dassault Falcon as a representative aircraft type, ObsidianFalcon does not guarantee the provision of any specific aircraft model or registration.
All published rates are indicative and subject to change. The rate applicable to any Client shall be the rate agreed and locked at the time of executing the programme agreement or card purchase.
All payments are due in advance of programme commencement unless otherwise agreed in writing. Ownership share acquisitions require a deposit of 25% upon execution of the purchase agreement, with the balance due prior to title transfer. Jet Card balances are payable in full prior to activation. All amounts are stated in United States Dollars (USD). Wire transfer is the standard payment method. ObsidianFalcon does not accept payment by credit card for programme purchases above $10,000.
Cancellation of confirmed flights within 8 hours of the scheduled departure will incur the full hourly rate for the scheduled flight time. Cancellations made more than 8 hours in advance will not be charged. Jet Card balances are non-refundable but are fully transferable between programmes or to a third party with ObsidianFalcon's prior written consent. Ownership shares may be sold or transferred subject to the terms of the individual programme agreement.
ObsidianFalcon guarantees an 8-hour departure window from request to wheels-up, subject to the following conditions:
In the event the aircraft is unavailable due to unscheduled maintenance, ObsidianFalcon will arrange a comparable charter substitution at no additional cost to the Client, provided reasonable notice is given.
All passengers travelling on ObsidianFalcon-operated aircraft agree to the following:
ObsidianFalcon's liability to any Client for any claim arising under or in connection with a programme agreement shall not exceed the total fees paid by the Client to ObsidianFalcon in the 12 months preceding the claim. ObsidianFalcon shall not be liable for indirect, consequential, special, or punitive damages of any kind.
ObsidianFalcon maintains aviation liability insurance on all operated aircraft in accordance with UAE GCAA requirements and applicable international standards. Passenger liability coverage is included. Clients are advised to maintain their own personal travel insurance for trip cancellation, baggage, personal medical, and ancillary risks. Fractional Ownership co-owners' interests are covered under the aircraft hull and liability policy maintained by ObsidianFalcon as operator.
ObsidianFalcon shall not be in breach of any programme agreement and shall have no liability to the Client for any failure or delay in performance caused by circumstances beyond ObsidianFalcon's reasonable control, including but not limited to: acts of God, war, terrorism, civil unrest, government action, regulatory change, pandemic, severe weather, air traffic control restrictions, or supplier failures.
ObsidianFalcon treats all client information with the highest level of confidentiality. Client data is not shared with third parties except as required to deliver the contracted services (flight operations, visa facilitation, accommodation booking) or as required by applicable law. ObsidianFalcon complies with applicable UAE data protection regulations.
The ObsidianFalcon name, wordmark, Falcon logo, and all associated branding elements are the intellectual property of Zeytoun Dynamics Ventures LLC FZ. All website content, including text, design, and code, is protected by copyright and may not be reproduced without prior written consent.
ObsidianFalcon reserves the right to amend these Terms and Conditions at any time. Clients will be notified of material changes via the contact details provided in their programme agreement. Continued use of ObsidianFalcon services following notification of changes constitutes acceptance of the amended terms.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Dubai Courts, or if elected by either party, the courts of the Dubai International Financial Centre (DIFC).
